24-hour Answer Claim

My Expert Solution, LLC ("MyExpertSolution") or its experts ("Experts") generally answer questions submitted through this Site within 24 hours. However, given variables in Expert schedules, non-business day submissions, technology limitations and other circumstances outside of MyExpertSolution's control, MyExpertSolution cannot guarantee that all questions will be answered within 24 hours of submission and expressly disclaims responsibility or liability in the case of this occurrence.

Electronic Communications

When you visit or communicate with MyExpertSolution, you consent to receive electronic communications from us. We will communicate with you by e-mail or by posting notices on this Site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

All content included on this Site, including text, graphics, logos, audio clips and digital downloads, is the property of MyExpertSolution or its content suppliers and is protected by United States and international copyright laws. Your Membership Account

If you use this Site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer and you agree to accept responsibility for all activities that occur under your account or password. If you join MyExpertSolution, you are stating that you are 18 years of age or older. MyExpertSolution and its associates reserve the right to remove or edit content, refuse service, terminate accounts or cancel orders in their sole discretion.

Unused membership plans do not carry over from one month to the next.

Each member receives one question per month with membership. Questions expire 30 days after purchase of membership or renewal of membership. Additionally, new members receive one (1) free question upon initial membership purchase, and this question expires 30 days from date of initial membership purchase. Any additional questions purchased expire 30 days from purchase date.

Payment

MyExpertSolution accepts Visa, Master Card, Discover, and American Express. Your credit card will be charged immediately upon membership activation for the first month of membership. Thereafter, your credit card will be automatically charged each month for the upcoming month of subscription based on your membership activation date.

Cancellation of Membership

Cancellation of membership to MyExpertSolution must be made through http://www.myexpertsolution.com/renewals/ . Membership fees for current or prior months' services are non-refundable. Cancellation is effective for the next scheduled billing cycle. You will maintain full access to MyExpertSolution.com and its resources through the end of the active membership period.

Questions, Comments, Suggestions and Other Content

Currently subscribed members may submit questions to MyExpertSolution and receive personalized responses from MyExpertSolution Experts. However, Experts are not obligated to reply to questions that are obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights or otherwise injurious to third parties. Reviews or comments submitted to the Site must also not be illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights or otherwise injurious to third parties and must not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity or otherwise mislead as to the origin of content. MyExpertSolution reserves the right (but not the obligation) to remove or edit such content.

Risk of Loss and Shipping

All items purchased from MyExpertSolution are made pursuant to a shipment contract. The risk of loss and title for such items pass to you upon our delivery to the carrier. There are no refunds on any downloaded products or materials. This includes audio, video, MP3, white paper, and any online training or educational programs. No refunds or returns on shipped items. No shipping & handling refunds.

Product Descriptions

MyExpertSolution and its associates attempt to be as accurate as possible. However, MyExpertSolution does not warrant that product descriptions or other content of this Site is accurate, complete, current or error-free. If a product offered by MyExpertSolution itself is not as described, your sole remedy is to return it in unused condition.

Not a Minor

The Site is intended for adult use only and minors under the age of 18 are not permitted to use this Site except in the manner provided herein. By using this Site, you represent that you are over the age of 18 and of legal capacity to form binding contracts.

State Tax

Sales tax for items purchased from MyExpertSolution will be collected only on items sold to residents of the State of Utah where MyExpertSolution has a physical presence. Sales tax will not be collected or remitted for products sold to individuals or institutions in any other state. However, the law requires that those out-of-state individuals or institutions must declare their purchases on their individual tax returns and pay a use tax for these purchases. If you are not a resident of Utah and purchase a product from this Site, you agree to indemnify MyExpertSolution for any losses it incurs as a result of your failure to pay use tax on your purchase.

Disclaimer of Warranties and Limitation of Liability

Disputes

Any dispute relating in any way to your visit to MyExpertSolution.com or to products you purchase through MyExpertSolution.com shall be submitted to confidential arbitration in Utah unless you have in any manner violated or threatened to violate MyExpertSolution's intellectual property rights, in the which case MyExpertSolution may seek injunctive or other appropriate relief in any state or federal court in the State of Utah. You consent to exclusive jurisdiction and venue in such courts. Arbitration under this agreement shall be conducted under the rules then prevailing of the American Arbitration Association. The arbitrator's award shall be binding and may be entered as a judgment in any court of competent jurisdiction. To the fullest extent permitted by applicable law, no arbitration under this Agreement shall be joined to an arbitration involving any other party subject to this Agreement, whether through class arbitration proceedings or otherwise.
